Your order is subject to Symmetry Resources Terms of Sale in effect at the time your order is placed.

Payment Terms

Payment Terms will be CBM (Cash Before Manufacture) unless alternate terms are approved. Payment terms are printed on the face of your order confirmation and are subject to change before shipment.

Pricing

Prices are subject to change, and Symmetry Resources reserves the right to discontinue any pattern or color without prior notice. All prices are FOB Connelly Springs, NC.

Cancellation Policy

Order cancellation is at Symmetry Resources sole discretion and may be subject to cancellation charges.

Claims

Customers should examine all products upon receipt to verify that they are as ordered. Claims relating to product defects or mis-shipped orders must be submitted in writing to Symmetry Resources no later than 60 days from date of invoice. A Return Authorization is required prior to returning a claim. To request a Return Authorization, please contact your sales representative or customer service customerservice@symmetryresources.com and include your order information. The Return Authorization must be included in the return to ensure accurate processing of your claim and must be received by Symmetry Resources within 30 days of Return Authorization issue date for credit to be processed. Symmetry Resources will correct the order and reship at its cost or, if not possible, will issue a refund or credit.

Return Policy

Symmetry Resources products are “made to order”; therefore, returns are at Symmetry Resources sole discretion. If a return is requested and approved by Symmetry Resources, a 50% restocking charge plus return freight cost will apply. All return requests must be received within 90 days of the original invoice date. Only full rolls, unopened and in their original packaging, will be considered for refund.

Warranties

Unless otherwise stated, Symmetry Resources products meet or exceed ACT quality and performance standards. Additional after-market finishes applied after purchase will void any Symmetry Resources warranty. Symmetry Resources guarantees that its products will perform in accordance with accepted industry standards when used under normal conditions, with proper maintenance and for the purpose intended.

Uncollected (Idle) Shipments

Any order prepared for shipping, but which remains uncollected (idle) at the Symmetry Resources warehouse in North Carolina for longer than 10 business days, shall incur a daily storage fee of $50, charged on the invoice, for as long as the order remains idle and until it leaves the Symmetry Resources warehouse.

Collection Fees

Any action taken to enforce collection of any balance due, including any check returned unpaid is subject to additional collection and/or attorney fees and costs, in addition to any interest and/or late payment charges payable.

Natural Fibers

Irregularities in hue and texture are integral to the character of textiles utilizing natural fibers; as such, color matches cannot always be guaranteed. If an exact color match is required, a cutting for approval must be requested when an order is placed.

Pattern Repeats

Patterned textiles should be cut by design and not by “pulled thread.” Allow for slight variation in repeat dimensions.

Testing

Unless otherwise stated, Symmetry Resources products meet or exceed ACT quality and performance standards. Commonly required textile test information is available via symmetryresources.com.

Limitation of Liability

EXCEPT FOR THE WARRANTY SET FORTH ABOVE, SYMMETRY RESOURCES DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL SYMMETRY RESOURCES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES RESULTING FROM YOUR PURCHASE, EVEN IF SYMMETRY RESOURCES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SYMMETRY RESOURCES’S ENTIRE LIABILITY FOR ANY PRODUCT SALE WILL NOT EXCEED THE TOTAL AMOUNT ACTUALLY RECEIVED BY SYMMETRY RESOURCES FROM SUCH SALE.

Intellectual Property

Symmetry Resources is the exclusive owner of all intellectual property in Symmetry Resources products and designs. Your purchase order does not authorize you to reproduce, resell or otherwise use Symmetry Resources product designs and materials other than in specific projects.

You may not display Symmetry Resources trademarks, except with prior written consent.

Waiver and Severability

Symmetry Resources failure to exercise or enforce any Term of Sale will not constitute a waiver of these. If any Term of Sale is held to be unenforceable, all other Terms of Sale will remain in effect.

Governing Law

THESE TERMS OF SALE, AND THE RELATIONSHIP BETWEEN YOU AND SYMMETRY RESOURCES, WILL BE GOVERNED BY THE LAWS OF THE STATE OF NORTH CAROLINA, WITHOUT REGARD TO ITS CONFLICT OF LAW PRINCIPLES. YOU AGREE THAT ALL LEGAL CLAIMS BETWEEN YOU AND SYMMETRY RESOURCES ARISING FROM THESE TERMS OF SALE, YOUR USE OF THE SYMMETRY RESOURCES WEBSITE, AND/OR YOUR RELATIONSHIP WITH SYMMETRY RESOURCES, SHALL BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED WITHIN THE STATE OF NORTH CAROLINA, COUNTY OF BURKE, AND YOU WAIVE ANY AND ALL OBJECTIONS TO SUCH VENUE BASED UPON PERSONAL JURISDICTION, VENUE, CONVENIENCE OF THE FORUM, OR ANY OTHER BASIS.
